What is Legal Aid?

Legal aid is a government-funded service that helps people who cannot afford to pay for legal representation and in family law is available for those who have experienced domestic abuse or are at risk of it, as well as for children in need of protection.

Who is it Available For?

Legal Aid is available for those who have experienced domestic abuse or are at risk of it, as well as for children in need of protection. Domestic abuse can take many forms, including:

Psychological abuse
Physical abuse
Sexual abuse
Financial abuse
Emotional abuse

If you have been a victim of domestic abuse, or if your case is considered exceptional, legal aid may be available in the following areas of family law:

Child matters, such as deciding where a child will live and who they will spend time with
Care proceedings
Non-Molestation Orders and Occupation Orders

Am I Eligible for Legal Aid?

To qualify for legal aid, you must pass two key tests:

The Means Test:

This test looks at your financial situation to determine if you qualify for legal aid. It considers your income, savings, and household circumstances. If your income falls below a certain threshold, or if your savings are low, you may qualify for legal aid. This ensures that legal aid is available for those who cannot afford private legal fees.

The Merits Test:

This test evaluates whether your case has a strong chance of success. It looks at whether the benefit of pursuing legal action justifies the cost of the proceedings. To qualify, your case must have a 50% or greater chance of success. If the case is unlikely to succeed, legal aid may be denied.

Answers to commonly asked questions about our divorce services:

  • A typical no-fault divorce takes around 26 weeks (six months) from the application to the final order. However, if financial or childcare arrangements are involved, these can take longer to resolve separately.

  • Our typical cost for an uncontested divorce is £500.00 plus VAT(total of £600.00) .The court fee for a divorce application is £593.00 which maybe waived if you are on  a low income. Additional legal costs depend on whether you seek legal representation and the complexity of your case.

  • Divorce doesn’t determine child arrangements, but we can help you agree on custody, visitation, and financial support. If an agreement can’t be reached, the court may decide based on the child's best interests.

  • If you are experiencing domestic abuse, we can help you obtain urgent legal protection, such as non-molestation orders or occupation orders to keep you and your children safe. You may also be eligible for legal aid in these circumstances.

  • You'll need to complete a divorce application, either alone or jointly with your spouse. After submitting it, there is a 20-week reflection period before applying for a conditional order, followed by a final order six weeks later, which legally ends the marriage.

  • Most divorces are handled online without a court appearance. However, if financial disputes or child arrangements cannot be agreed upon, court hearings may be necessary.

  • No, under the no-fault divorce system, one person can apply, and the other cannot contest the divorce, except in very limited circumstances.

  • Financial settlements, including property, savings, pensions, and debts, are separate from the divorce itself. We can help negotiate a fair financial agreement or apply for a financial order if needed. See Finance & Separation

  • Yes, once the final order is issued, you are legally free to remarry.

When is Legal Aid Available?

Legal aid is available to individuals who:

Receive Benefits

Are in receipt of certain benefits (known as "passport benefits")

Low income 

Have a low income and minimal savings

If you receive any of the following benefits, you are automatically financially eligible for legal aid:

Income Support
Jobseeker's Allowance (income-based)
Employment and Support Allowance (income-based)
Pension Credit – Guarantee Credit
Universal Credit

Even if you are employed, you may still qualify for legal aid, but you could be required to contribute toward your legal fees. If you have a partner, their income will also be taken into account during the financial assessment.

Evidence Required for Legal Aid

When applying for legal aid, you will need to provide:

Proof of your financial situation
  • Recent letters detailing the benefits you receive

  • Bank statements

  • Wage slips

Evidence of domestic abuse, if applicable
