Property

This includes the family home, rental properties, or any other real estate owned by either or both parties. The court will consider the equity in these properties and how they should be divided.

Savings and Bank Accounts

Any money held in personal or joint accounts, including savings accounts.

Pensions

Pensions accumulated during the marriage, whether through an employer, private savings, or state pension. These can be divided in different ways, such as through pension sharing or offsetting.

Investments

This includes stocks, bonds, mutual funds, and other investment vehicles owned by either party, including business shares or ownership in companies.

Business Interests

If one or both parties own a business or have a stake in a business, the court will consider its value and how it should be divided or compensated for.

Personal Property

This includes personal possessions like vehicles, artwork, jewelry, collectibles, and other valuable items that may have been acquired during the marriage.

Debts

Resolving Financial Matters After Divorce

When you divorce, settling financial matters is important. Our goal is to help you reach a fair agreement as quickly as possible to save you both time and money. These stages guide you toward a fair and clear resolution.

Stage 01:
Negotiations and Disclosure

In this first stage, both parties share financial information, including assets, income, and debts. Open communication is key. The aim here is to reach an agreement through negotiations, avoiding court if possible, using a Consent Order.

Stage 02:
First Directions Appointment (FDA)

The FDA is the first official court meeting. It reviews how things are progressing, addresses any problems, and sets out the next steps. The judge may also set deadlines for sharing financial details and provide guidance on moving forward.

Stage 03:
Financial Dispute Resolution Hearing (FDR)

The FDR hearing is a more detailed session where both sides present their financial situations. The judge may give an indication of how they would rule if the case went to a final hearing. This is an opportunity to settle with the judge’s help, often leading to an agreement.

Stage 04:
Final Hearing

If an agreement isn’t reached at the FDR, the case moves to the final hearing. At this stage, both parties present their evidence, and the judge makes the final decision on how to divide assets, debts, and any other financial matters. This decision is legally binding.
