Domestic abuse is a serious issue that affects many individuals and families. The Domestic Abuse Act 2020 defines domestic abuse as any behaviour that causes harm by a spouse or partner. We act swiftly and efficiently to secure the necessary court orders to protect you, with a focus on Non-Molestation Orders and Occupation Orders. Both types of orders can be crucial in ensuring your safety and protecting you from further harm. Non-molestation Order

This legal order prohibits someone from using violence, threats, or harassment against you or your children. It also covers acts of intimidation or pestering. Breaching a Non-Molestation Order is now a criminal offence, and those who violate the order can face arrest and imprisonment.

Occupation Order

An Occupation Order requires a partner or spouse to vacate the family home and may also restrict access to the surrounding area. If the order is breached, the police have the authority to arrest and detain the individual involved.

What is considered domestic abuse?

This is typically a pattern of abusive behaviour within an intimate partner or family relationship, where the abuser exerts power and control over the victim as defined in the Domestic Abuse Act 2020.

Physical harm

Physical abuse involves intentional bodily injury. Examples include slapping, pinching, choking, kicking, shoving, or the inappropriate use of drugs or restraints. Victims may also experience unexplained physical symptoms such as headaches, fatigue, or abdominal pain, which are often linked to the abuse.

Sexual harm

Sexual abuse involves forcing a partner into sexual acts without their consent. You may be in a sexually abusive relationship if your partner accuses you of cheating, displays excessive jealousy, or pressures you into sexual behaviour or dress that you do not consent to.

Emotional harm

Emotional abuse occurs when an abuser uses words and non-physical actions to manipulate, hurt, scare, or upset the victim. This can include yelling, name-calling, mocking, belittling, or isolating you from friends and family. Often, emotional abuse is used to make the victim feel worthless or dependent.

Financial harm

Financial abuse involves controlling or limiting access to money, assets, or financial independence. Examples include forcing the victim to take out credit in their name, failing to contribute to bills, or draining joint bank accounts. Many victims experience a combination of financial and other forms of abuse.

  • A Non-Molestation Order is a protective injunction under the Family Law Act 1996, designed to protect you from harm, harassment, or threats of violence by a partner or former partner. It prohibits the respondent from contacting or approaching you, and it can include prohibitions on verbal or physical abuse, intimidation, or harassment.

  • An Occupation Order is another type of injunction under the Family Law Act 1996, which can order a partner or ex-partner to leave the family home. It can also limit their access to the home or prevent them from coming near certain areas, ensuring your safety within the property.

  • You can apply for these orders if you are a spouse, civil partner, cohabitant, or former partner of the individual. You can also apply on behalf of your children if they are at risk of harm from the abuser.

  • To apply for either of these orders, you must show that you are at risk of harm, or you are already experiencing harm, due to the respondent’s behaviour. For a Non-Molestation Order, evidence of harassment, threats, or violence is required. For an Occupation Order, there must be evidence of a need to be protected from harm in the home.

  • Evidence can include police reports, medical records, witness statements, photographs of injuries, texts, emails, or any other proof of threats or violence. The more compelling and clear the evidence, the stronger your application will be.

  • No, these orders require court proceedings. However, in urgent situations, the court can issue a temporary order without the abuser being present, and a full hearing can follow.

  • If the respondent breaches the order, they can be arrested and face criminal charges. A breach of a Non-Molestation Order is a criminal offence, which can result in up to 5 years in prison. Violating an Occupation Order can lead to arrest or other legal consequences.

  • Yes, either order can be varied or discharged (removed) if circumstances change. You may also apply for changes if you feel the order is no longer needed or if it is too restrictive.

  • Yes, you may be eligible for legal aid if you are a victim of domestic abuse. Legal aid can help cover legal advice, representation in court, and other costs associated with obtaining a Non-Molestation or Occupation Order. Eligibility depends on income, savings, and proof of abuse.

  • Non-Molestation Orders are typically granted for a period of up to 12 months, but they can be extended if necessary. Occupation Orders are usually granted for a shorter period, but can be extended based on your ongoing need for protection. The length of both orders depends on the circumstances of your case.
